§ 36-34. Appeals.

  • Any person aggrieved by an objection to a plat or a failure to approve a plat may appeal therefrom, within 60 days of notification of such objection or rejection of the plat, by presenting to a court of record a petition for a writ of certiorari directed to the town council. The court shall direct that the plat be approved if it finds that the action of the town council is arbitrary, unreasonable, or discriminatory.
